Reading and synthesizing a large number of documents is the basis of administration of justice. Some documents have a standard format. While the number of cases is on the rise, the magistrates are not able to handle all of them in a timely manner.

Patrick Sayer (the new president of the Paris Commercial Court elected in January of 2024) has been bolstered by these observations and appointed a magistrate consular to serve as an artificial intelligence point-of-reference.

The Paris Commercial Court has 180 judges elected, who each have to examine around 60 cases per year and participate in almost 200 judgments. There are many recurring procedures such as those where a company has disappeared and the bank is left with a negative balance. Companies that fail to pay back their PGE (state-guaranteed loans).

Generative artificial intelligence to synthesize procedural elements

Paris Commercial Court launched its initiative with an anonymized version of ChatGPT 4, which included: names, addresses, trademarks SIRET numbers, etc. ; elements of proceedings (plaintiff and defendant submissions) and dockets containing exhibits submitted by both parties.

It is important to create pre-reports that contain all the necessary elements. It is especially useful for cases that are repeated. For example, a financial leasing firm may initiate 200 legal proceedings against its clients for non-payment. The company sends out a payment order every time for several hundred euros. The court registers are clogged up as the cases must be dealt with administratively.

The court’s registry needs to complete a reading in very little time.

Generative AI is perfectly suited to the task of reading and synthesising digitized files.

The Paris Commercial Court, after the testing phases that took place over 2024 will launch a special instance in December/January 2025: “Litigation Handling Improvement Chamber”.

They will use algorithms that are uncreative and indicate whenever they do not know the answer to a question. The role is limited to that of an editorial assistant. The tests done so far for this position show that the ratio between the amount of time it takes to prepare pre-reports and the actual report is 6:1.

There will be a human supervisor to make sure the document base is of high quality. For example, removing outdated case law and adding new ones.

No question of entrusting a judgment to AI

You can easily produce summaries, identifying information in a collection of documents, and pre-draft deeds. Payment orders will go to the bailiff with information like debtors’ names, contact numbers, amount, and file reference.

The Paris Commercial Court will handle 20,000 cases of this kind in 2023. Automating their processing would accelerate them. This would free up the clerk’s staff to do more complex tasks.

This is the exact same judgment.

The exclusive right to make a judgment in this case must be reserved for consular judges. There’s also no chance of artificial intelligence delivering automated judgments.

It’s always about the judge at the end of it all.
